Terms and Conditions

Last updated: 2026-09-07. This English version is provided for information only; the German version is legally binding.

1. Scope and seller

These terms apply to all orders placed via musicxplosion.de. The seller is Peter Leis, Brunnengasse 9, 67705 Stelzenberg, Germany ("we"). Contact details are in the imprint.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

We offer exclusively used sound carriers (vinyl records, CDs, cassettes) from a private collection. Every item is unique and available only once.

2. Conclusion of contract

The presentation of items on the website is not a binding offer but an invitation to order.

You can add items to the cart and change or remove them at any time. Before submitting, you see all details in the order summary and can correct them. By clicking "Place binding order" you submit a binding offer to buy the items in your cart.

We confirm receipt of your order by e-mail without delay. This confirmation is also our acceptance of your offer; the contract is concluded when it reaches you. The contract text (order data, these terms, withdrawal instructions) is sent with that e-mail and stored by us.

If an item has already been sold elsewhere between your order and our confirmation, we will inform you immediately; no contract is formed for that item and any payment already made for it is refunded at once.

The contract language is German. The English version is for information only; in case of discrepancies the German version prevails.

3. Prices and shipping

All prices are final prices in euros. No VAT is shown.

The minimum order value is €25.00 (item value excluding shipping). Orders below this value are not possible; the cart points this out before you order.

Shipping costs depend on the delivery zone and are shown in the cart and in the order summary before you order. Details under Shipping & payment. Deliveries outside the EU may incur customs duties and import taxes, which you bear as the recipient.

4. Payment

Payment is made in advance by bank transfer or PayPal. You receive the payment details with the order confirmation. The purchase price is due within 7 days of the conclusion of the contract.

If payment has not arrived within 7 days, we may, after a reminder with a reasonable grace period, withdraw from the contract and offer the item again.

5. Delivery

We ship within 3 working days after receipt of payment. Expected delivery times per zone are listed under Shipping & payment. Orders are shipped complete in one parcel.

For consumers, the risk of accidental loss or deterioration passes only upon handover to you. For businesses, the risk passes upon handover to the carrier.

6. Condition of used sound carriers

All items are used sound carriers from a private collection. The condition is stated per item, separately for the media (vinyl or CD) and the sleeve (cover, inlay, case), according to the Goldmine standard. This grading describes the agreed condition of the item and forms part of the contract. Signs of use consistent with the stated grade are not a defect.

Meaning of the grades:

  • M (Mint): as new, without any sign of use; sealed copies are unopened.
  • NM (Near Mint): nearly as new; media without audible impairment, sleeve with at most minimal storage marks.
  • VG+ (Very Good Plus): light signs of use, such as fine hairlines or slight edge wear, that do not materially affect listening.
  • VG (Very Good): noticeable signs of use; light surface noise or occasional crackle possible, sleeve with visible wear.
  • G (Good): heavy signs of use; plays through but with audible noise; sleeve clearly damaged.

Particularities beyond the grade (e.g. writing, cut-outs, missing inserts) are stated in the item description. Before placing the order you expressly confirm that you are aware of the used condition as stated and agree to it.

7. Warranty

Statutory warranty rights apply. For used goods the limitation period for warranty claims is two years from delivery; no reduction is agreed.

There is no defect if the item conforms to the agreed condition under section 6.

8. Right of withdrawal

Consumers have a statutory right of withdrawal. The withdrawal instructions, the model form and the online withdrawal function are available under Right of withdrawal. The right of withdrawal does not apply to sealed audio or video recordings if the seal has been removed after delivery.

9. Retention of title

The goods remain our property until paid in full.

10. Liability

We are liable without limitation for damage resulting from injury to life, body or health, in cases of intent and gross negligence, and under the German Product Liability Act. For slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely), liability is limited to the typical, foreseeable damage. Otherwise liability for slight negligence is excluded.

11. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. For questions or complaints you can reach us at any time at [to be entered in Admin → Shop settings]; we aim for a quick, direct solution.

12. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the law of the state in which you have your habitual residence.
